Federal court rules in favor of lawsuit challenging SNAP benefit restrictions

West Virginia (WOAY) A federal court has ruled in favor of a lawsuit challenging food restriction waivers in several states. 

The lawsuit, brought by the National Center for Law and Economic Justice and Shinder Cantor Lerner LLP, challenged waivers approved by the U.S. Department of Agriculture that allowed restrictions on certain foods purchased through the Supplemental Nutrition Assistance Program, or SNAP. 

The court granted summary judgment in favor of the plaintiffs and vacated the waivers in West Virginia, Colorado, Iowa, Nebraska, and Tennessee. 

Following the ruling, the National Center for Law and Economic Justice Senior Attorney Katharine Deabler-Meadows states, “The Court’s ruling is a major step in restoring essential food assistance to the millions of families that rely on SNAP nationwide.”

Deabler-Meadows further said, “This decision makes clear that the USDA cannot bypass the legal guardrails that establish how SNAP must operate across the country. It affirms that families deserve a program that works without confusion.”
