BECKLEY, WV (WOAY) – A 2024 harassment and discrimination lawsuit against former Raleigh County Circuit Clerk Bob McComas has been dismissed.
During McComas’ tenure, the plaintiffs accused him of impropriety and allegedly creating a toxic work environment.
“McComas’ conduct of sexual harassment, racial discrimination, gender-based harassing, and physical aggression was so pervasive and intolerable the plaintiffs suffered extreme emotional distress, anxiety and humiliation.”
He has since resigned following the county’s investigation.
Raleigh County has committed to enhanced workplace policies and partnered with a pair of HR firms to address concerns.
The plaintiffs didn’t pursue this case for personal gain, according to Attorney Robert Dunlap, but to protect Raleigh County employees from discrimination and workplace hostility.
“These folks were outed as whistleblowers in certain publications that I won’t name,” Dunlap said. “That’s unfortunate because you should be able to have your identity protected when you’re brave enough to come forward under these circumstances.”
He says it’s exciting that they can now close this chapter.
“Mr. McComas’ resignation, the investigation into him was huge,” Dunlap said of the old-boys network of sometimes making crass, sexually charged, horrible and racist remarks. “And (they think) that’s okay.'”
This lawsuit sent a strong message.
“When these folks stood together and said it’s not okay they spoke for all the individuals in that office,” Dunlap said. “And thank goodness they did, because now it’s a safer place to work.”
