Kanawha County, WV (WOAY) – The West Virginia Supreme Court of Appeals has issued a scheduling order that sets deadlines in the appeal of a Raleigh County Circuit Court decision that paves the way for unvaccinated children to enroll in public schools.
The appeal must be fully filed by March 26. The respondents must file their brief by May 11, and the final reply must be in by June 1.
If any of those filings happen early, the deadlines are moved up.
The court has already granted a petition to stay Raleigh County Circuit Judge Froble’s ruling that school boards must honor religious exemptions to West Virginia’s mandatory vaccine law.
The case was brought by several Raleigh County families, but Judge Froble granted class action, seemingly allowing the case to apply state-wide.
Following the stay, the West Virginia State School Board says it is enforcing its vaccine policy while the Supreme Court considers the case.
