Charleston, WV (WOAY)-The West Virginia Supreme Court of Appeals agreed to uphold Fayette County Circuit Court’s 2022 ruling in a case involving the death of 8-year-old Raylee Browning.
Court officials indicted the girl’s father, Marty Browning, his wife, Julie Titchenell, and her sister, Sherie Titchenell, for one count of death of a child and child neglect resulting in death.
The jury acquitted the defendants of abuse charges in a six-day joint trial, but convicted all three on neglect charges.
According to an autopsy report, Browning passed away in 2016 of sepsis caused by pneumonia.
Testimony from medical experts showed the girl did not receive medical treatment, despite exhibiting apparent symptoms.
Further evidence showed the girl was malnourished and dehydrated.
The three of them were sentenced to three to fifteen years in prison.
The defendants later filed petitions, accusing the circuit court of improperly admitting evidence, limiting the examination of witnesses, and allowing hearsay testimony.
The appeals court reviewed the evidence submitted for the appeal and found no substantial question of law or prejudicial error.
