West Virginia Rivers Coalition and West Virginia Highlands Conservancy file federal lawsuit against Amsted Graphite Materials alleging Clean Water Act violations

West Virginia (WOAY) West Virginia environmental groups are taking legal action against a graphite manufacturing company in Harrison County.

The West Virginia Rivers Coalition and the West Virginia Highlands Conservancy filed a federal lawsuit against Amsted Graphite Materials, alleging repeated violations of the Clean Water Act at the company’s facility in Anmoore.

According to the complaint, the company discharged wastewater, stormwater runoff, and groundwater into Anmoore Run and nearby tributaries connected to Elk Creek, the West Fork River, and the Monongahela River.

The lawsuit alleges Amsted exceeded permit limits for pollutants, including lead, copper, zinc, chlorine, and several toxic compounds known as PAHs.

Environmental groups say the company failed to complete required upgrades and continued reporting violations in its monthly monitoring reports.

The lawsuit seeks a court order requiring Amsted to comply with its water pollution permit, stop future violations, and pay civil penalties.
