Raleigh County, WV (WOAY) – A Raleigh County Circuit Court Judge has recused himself from a high-profile case dealing with mandatory vaccine exemptions.
Judge Todd Kirby issued the voluntary recusal order, saying it is important to avoid the appearance of conflict.
Kirby is a former delegate who co-sponsored the Equal Protection for Religion Act, a bill that Governor Morrissey says allows the state to offer religious exemptions for mandatory vaccines.
Miranda Guzman is suing the Raleigh County and State Boards of Education over their policies that prevent religious exemptions, citing state law. Her lawsuit says she wants to let her unvaccinated four-year-old attend preschool, citing Christian beliefs against vaccines using aborted fetal cells.
The governor is supporting her lawsuit.
