Man faces several charges following domestic dispute in Wyoming County.

Clear Fork, WV (WOAY) A man is facing several charges in Wyoming County following a domestic dispute.

According to Wyoming County Magistrate Court documents, authorities responded to a call on Tuesday, May 5, at a residence in the Clear Fork area.

Upon arrival, police spoke with a woman who reported she was physically assaulted, further stating that the suspect was intoxicated and driving to his residence in Matheny.

The suspect was later identified as Franklin Stewart.

In a written statement to authorities, she reported she contacted Stewart to inform him of a verbal dispute with another individual over a dog.

Stewart replied, insisting on coming over, and she reportedly told him not to several times.

Allegedly, he showed up at the residence anyway and was believed to be under the influence.

The victim told him that he should not be driving in his condition, and Stewart got angry.

The victim then told him to leave because her grandchild was in the home and she did not want her to hear them arguing.

Stewart then allegedly grabbed and twisted the victim’s arm, and she responded by telling him to let her go and hit his arm in retaliation.

Following a physical altercation, the victim told him to leave again, and he responded by issuing a death threat towards her and her children.

Stewart reportedly continued to argue with the victim and then grabbed her throat, continually asking if she could breathe.

The victim then reports hitting Stewart in the face to get him to let her go and then striking him again with an air fryer in an attempt to render him unconscious.

Stewart asked the victim repeatedly why she hit him, then reportedly grabbed her and forcefully threw her to the ground, causing her to hit her head.

Stewart reportedly held her down and rubbed blood on her, leading the victim to strike him again with a nearby dog bowl.

Once he let her go, Stewart once again continued to ask why the victim hit him, and the victim again asked him to leave.

Stewart left briefly, then returned to the home’s front porch, stating that he would not forgive her.

The victim’s granddaughter reported to authorities that she was going to bed and woke up to hear screaming.

She reports calling her mother, who asked if her grandmother was ok.

The child reports going to see what was happening and discovering the suspect with blood on his forehead and her grandmother with blood on her hands.

She told her mother what she saw after returning to her bedroom, who then called the police while the child locked the bedroom door and put a chair in front of it as the dispute continued to escalate.

Oceana Police located Stewart in his car and detained him until Corporal Walker arrived to arrest him.

Stewart has been charged with unlawful restraint, domestic battery, strangulation, and child neglect, creating risk of injury.

He awaits further court proceedings in Southern Regional Jail on a $55,000 cash bail.
