Latest on proposed sale of several Fayette County public service districts to West Virginia American Water

Kanawha County, WV (WOAY) – New details in tonight about the proposed sale of several Fayette County public service districts to West Virginia American Water.

The West Virginia Public Service Commission has granted the West Virginia Department of Environmental Protection’s petition to intervene in the case.

In a filing last week, the DEP raised issue with the language in the sales agreement, arguing that the list of debts owed is incomplete and is written in a way to allow the transaction to circumvent repayment of state loans.

It also says West Virginia American Water is prohibited by federal law from holding loans given to public utilities.

The County Commission and West Virginia American Water are continuing to assert that the terms of the agreement cover all outstanding debt.
