DANESE, WV (WOAY) – A Fayette County man has been arrested after allegedly shooting his brother in the foot.
Colby Martin has been charged with malicious wounding, brandishing a deadly weapon, wanton endangerment, shooting a gun within 500 feet of a home, obstruction and domestic battery.
Police say Martin and the alleged victim, his brother, got into an argument and altercation over an alleged affair between the victim and Martin’s girlfriend.
Martin eventually told police that he grabbed his shotgun, loaded it, and fired it toward the ground to try to get the victim to leave the property. He claimed that he was not trying to shoot his brother.
A witness said she heard the shotgun go off while she was trying to get two children away from the scene. She said that Martin ran into the house, dropping the shotgun on the ground. She said she picked up the gun and fled the scene with the children.
When police arrived, Martin allegedly refused to come out of the house and drop a rifle he was carrying. A 2-year-old was still in the room with him.
While Martin was distracted at the front door, state troopers entered through the back and used a Taser to subdue him and wrestle the rifle away.
During the investigation, officers found a hole in the ground that looked it could have been caused by a shotgun blast. There was also a blood trail leading away from the area.
The victim suffered a gunshot wound to the left foot and received medical care.
Court records indicate that Martin posted a $100,000 bond on the morning of March 10.
