Fayette County, WV (WOAY) – At the Fayette County Commission meeting on Wednesday, the commissioners unanimously approved using county money to pay the legal fees of Kanawha Falls PSD that relate to the sale of the district to West Virginia American Water.
A total of $25,236.33 will be paid to attorney Todd Swanson in back legal fees covering through the end of June for his representation of the district.
An additional $9,763.67 cents will be paid as a retainer to Swanson to assist Kanawha Falls PSD with facilitating and signing the asset purchase agreement, bringing the total to $35,000.
Commissioner Allison Taylor emphasized that this is not an invitation for all counsel of remaining PSDs to come in and request legal fee assistance; it is specifically regarding the PSDs subject to the asset purchase agreement with West Virginia American Water.
The asset purchase agreement indicates the county, not West Virginia American Water, will be responsible for debt repayment.
