Federal judge rules that West Virginia’s lawsuit against Apple will remain in state court

West Virginia (WOAY) West Virginia’s lawsuit against Apple will remain in state court after a federal judge rejected the company’s request to move the case to federal court. 

Attorney General JB McCuskey alleges Apple’s business practices and product design decisions allowed child sexual abuse material to go undetected while failing to use available detection technology. 

The court ruled that Apple’s compliance with federal reporting requirements did not qualify the company for federal officer jurisdiction, sending the case back to West Virginia state court. 

Apple has filed notice that it intends to appeal the ruling.
