Oak Hill, WV (WOAY) – Good news for college athletes wanting to transfer schools.
U.S. District Judge John Preston Bailey ruled Wednesday that the NCAA cannot prohibit athletes from sitting out for a year after transferring colleges twice, issuing a 14-day temporary restraining order against the so-called transfer eligibility rule.
There will be a hearing on the injunction on December 27.
The anti-trust lawsuit was filed by Ohio, Colorado, Illinois, New York, North Carolina, Tennessee, and West Virginia, arguing the rule violates athletes’ ability to control their education and engage in the market for their labors.
The states also accuse the NCAA of issuing waivers for the rule to some athletes and arbitrarily denying others.
