The Oak Hill Detachment of The State Police were dispatched to Frasure Creek Mine and upon arrival, troopers found Johnny Martin Johnston Junior dead from a gun shot wound.

They also found Gary Gover suffering from internal injuries consistent from a fall. Gover was found to be a security guard employed at the mine. Initial reports indicated that Gover allegedly approached Johnston and another man named Russell Walker about trespassing on the property.

The confrontation was reported to have turned violent and resulted in Gover discharging a firearm at the men. Police found Walker, who ran after the incident, around 9pm that night.

Following the incident, Mine Safety and Health Administration Spokeswoman Amy Louviere said in a statement to the Bluefield Daily Telegraph that the trespassing was linked to an attempted theft.
