Hughart set to appear before two judges

BECKLEY - A former Massey Energy executive who's cooperating with the investigation into the Upper Big Branch Mine Disaster will face two judges in Beckley Tuesday.

David Hughart was scheduled to appear for a bond revocation hearing at 1:00 p.m. after he was recently arrested on drug charges.  Hughart will then go before U.S. District Judge Irene Berger to learn his sentence on a federal conspiracy charge.

He admitted to conspiring with others, giving miners at Massey subsidiary White Buck Coal illegal advanced warning about surprise inspections.  He was fired in March of 2010 after he failed a random drug test.

Hughart never worked at UBB where 29 men died on April 5, 2010, but he implicated former Massey CEO Don Blankenship in the advanced warning scheme. 

Blankenship denied any wrongdoing.
