WELCH - Two deputies suspended for not responding to a call in McDowell County that resulted in a death, have been reinstated.
McDowell County Sheriff Martin West tells Newswatch a county civil service board Monday dropped all charges against Deputies Michael Pertie and Timothy Vineyard due to a technicality.
West had suspended the Deputies for not responding to a domestic violence call at the home of Donald Baker in Beartown on May 14th where Wesley Payne threatened Baker and his girlfriend. On May 19th Wesley Payne shot and killed Baker, the deputies will return to active duty immediately.
