CHARLESTON - The new distracted driving laws take affect July 1 throughout the state of West Virginia. This allows law enforcement to give a $100 fine for not using a hands-free device.

The driver may be pulled texting as well as talking on the phone without a hands-free device. A law has been in place since July 2012 for using a cell phone while driving, however law enforcement could not pull a driver over for that reason alone.
