CHARLESTON - Fired state schools superintendent Jorea Marple will get her day in court in about a year.
U.S. District Judge Thomas Johnston scheduled her lawsuit against the state Board of Education for trial on April 22, 2014 in Charleston. Johnston also ordered that the parties try to settle the lawsuit by March 7, 2014.
Marple sued the state Board of Education in Kanawha County Circuit Court back in February, but the case was moved to federal court. Marple's lawsuit alleged that she was denied due process when she was abruptly fired in November of 2012 and that the dismissal's handling wrongfully damaged her reputation. The board cited lagging student performance and desire to head in a new direction with different leadership.
