The murder trial for a Mercer County man has been postponed

The case of Marcus McKinley, 26, has been delayed due to a conflict with the current prosecuting attorney. Defense attorneys introduced evidence today where Prosecutor Scott Ash had presented McKinley on a misdemeanor charge back in 2004.  The Mercer County Cirucit Clerk's Office confirmed the evidence. Judge Omar Aboulhosn will now send the recommendation of recusal to the state's Prosecuting Attorney Insitutite for a replacement. The trial is now scheduled to start in March, 2013.  McKinley is accused of killing Ayana Patton, 18, of Bluefield in May, 2011.
