Supreme Court Overturns Murder Conviction Reversal

The Supreme Court of Appeals reverses a judge's decision to overturn a Mercer County murder conviction last year.

Justices reinstated the conviction of David Lee Hurt by a 4 to 1 decision.   He was originally convicted of killing Freddie Lester in 1998 during a Bluefield gas station robbery.  Greenbrier County Judge Joseph Pomponio ruled Hurt's counsel was ineffective last April and ordered a new trial.  But the court found error in some of the reasons Pomponio cited in his decision.
