BECKLEY- A man serving life in prison was in court Tuesday to see if his previous trial was constitutionally fair.
Marvin Mills was previously convicted of first degree murder with no mercy after the shooting death of Pamela Cabe. On Tuesday, his present lawyer re-visited his 2003 trial in court, questioning Mills former defense attorney. They also questioned why certain evidence wasn't presented to the defense during the trial. Mills admitted to killing Cabe at the Richmond Dry Cleaners on South Kanawha Street back on September 8th, 1999. If ruled that Mills didn't have a constitutionally fair trial, he could have a new trial. That decision has not been made yet.
