Fayette County man charged with sex crimes against children

FAYETTEVILLE - A Fayette County man is in jail following allegations of committing sex crimes against children.

 Gale Wayne Swaggerty, 67, of Layland was arrested Monday afternoon in Raleigh County by officers from the Central WV Drug Task Force who were assisting the Fayette County Sheriff's Office. He is charged with ten felony counts of Sexual Abuse by a Parent, Guardian, Custodian or Person in a Position of Trust in Relation to a Minor Child, ten felony counts of First Degree Sexual Abuse and one felony count of First Degree Sexual Assault.

On Sunday, May 11, 2014 information was received through the Fayette County 911 Center concerning the possible sexual molestation of three minor children in the Danese area of Fayette County. The Sheriff's Office Detective Bureau was assigned to open an investigation into these allegations.

Swaggerty was arraigned in Raleigh County and is currently in jail on a $100,000 bond.

The possible penalty for each count of First Degree Sexual Abuse is five to twenty-five years in prison and the possible penalty for First Degree Sexual Assault is twenty-five to one hundred years in prison. Because of the age of the victims in this case, should he be convicted of one or more of these charges he would also be required to register as a sexual offender for the rest of his natural life.

"Investigations of this nature are made significantly easier because of the services provided by our Child and Youth Advocacy Centers," said Sheriff Kessler. "Our excellent working relationship with Child Protective Services is also of great importance in the successful resolution of these types of criminal investigations."
